Day 4 of 5: “Understanding the Texas One to Four… Until They Change It Again”

Ah yes—Paragraph 7 of the contract. The place where inspections turn into negotiations, and everyone suddenly becomes an expert in plumbing, roofing, and foundation grading overnight. 😂

This section is all about condition of the property, inspections, repairs, and what the seller is required to do (and what they’re not).


🔍 You Buy It As-Is… Kind Of

The default in the contract says you’re buying the home “as is.” That means the seller isn’t required to fix anything… unless you negotiate those repairs after the inspection. And yes, this is where the drama starts.

The buyer can ask for:

  • Repairs to be made by closing

  • A credit toward closing costs

  • Or to just say “no thanks” and walk during the option period

💡 Tip: Asking the seller to “repair the entire house” isn’t a strategy. Focus on health, safety, and major systems first.


🧾 Who’s Responsible for What?

Paragraph 7 also spells out who pays for:

  • Required inspections (buyer)

  • Required repairs (negotiable)

  • Any required treatments (like wood-destroying insects 🐜—yikes)

And don't skip the part about access—buyers have a right to inspect the property, and sellers have to make it available.


🛠️ Repairs Must Be Done by Professionals

If repairs are agreed upon, they must be completed by licensed contractors (if required by law) and receipts must be provided. So no, Uncle Bob can’t patch the roof with duct tape and a prayer.

💡 Texas translation: If it’s duct-taped, zip-tied, or held up by a rusty nail—it’s probably not contract compliant.


🧰 Home Warranties (Not the Same Thing!)

A home warranty is a separate service contract that covers certain repairs after closing. The contract can specify whether the seller is providing one, and for how much. Think of it as a little extra peace of mind (but not a get-out-of-fix-it-free card).


Bottom Line:

Paragraph 7 is where buyers get peace of mind… and sellers hold their breath. It’s a critical part of the deal, and where a good agent (hi, it’s me!) can make all the difference in navigating repairs and keeping both sides sane.
